Food Trucks Lose Court Battle

(SPRINGFIELD, Ill.) — The state’s high court has ruled that Chicago’s rules regulating food trucks are constitutional. Lower courts previously ruled in favor of the city.

The owner of the food truck Cupcakes for Courage Bakery, sued Chicago in 2012, saying the regulations unfairly suppressed competition.

City law mandates that food trucks be at least 200 feet away from businesses that serve food.

An attorney for the plaintiff tells the Tribune that in the coming weeks he’ll evaluate whether they should petition the U.S. Supreme Court.
