CupCakes for Courage owner Laura Pekarik failed to overturn what she had called burdensome and damaging rules governing food truck in Chicago. After a four year long court battle, a Cook County Circuit judge upheld two two main components of the food truck ordinance. Specifically the use of a city monitored GPS unit and a rule that says food truck must say at least 200 feet away from restaurants. Pekarik had claimed in her lawsuit that the rules were unconstitutional.
A number of food truck operators have long said that the rules have led to a loss of business. Some have gone out of business.
Pekarik’s attorneys say they will appeal the decision.
