Lawsuit Against White Sox Can Proceed

A Cook County Circuit Court Judge has found that a negligence lawsuit against the Chicago White Sox can move forward.
The judge ruled that New York Yankees player Dustin Fowler can proceed with his lawsuit after rejecting a motion filed by the White Sox to remove the case to federal court.
“This is a very significant ruling which will allow the case to proceed in Cook County where it was originally filed. We can now move forward and get answers to why the exposed electrical box was placed in a dangerous area and caused Dustin’s serious injuries,“ said Fowler’s attorney, Michael Sorich of the Cavanagh Law Group.
Fowler was playing in his first game ever as a major league baseball player for the New York Yankees last June when he hurt his knee running after a foul ball along the right field foul line while playing the White Sox at Guaranteed Rate Field. His knee hit an exposed electrical box on the wall. Fowler sued the White Sox, alleging that the club negligently installed the box in a position where it was undetectable and posed an unreasonable risk of injury to players.
A press release from the law group says Fowler suffered an injury that required surgery and ended his season. The electrical box was positioned behind and between the wall and railing next to the right foul line, without any kind of padding or covering.
In his lawsuit, Fowler alleged that the White Sox were aware of the hazard but took no action to fix it or let opposing players know about it.
