A San Antonio cop who was fired for giving a poop sandwich to a homeless man is getting his job back.
Officer Matthew Luckhurst on Monday won an appeal by calling upon a rule that requires officers to be disciplined within 180 days of an offending incident. Although the alleged prank was initially reported to have occurred on May 6, 2016, Luckhurst — a motorcycle cop — provided paperwork that showed he was unable to ride between April 6 and June 14 due to an injury. Although he was unable to provide the appeals board with an exact date, he successfully argued the incident must have happened before his injury, making his October 28, 2016 dismissal invalid.
Luckhurst is accused of committing the vulgar prank when he and another officer were clearing out homeless people from a private parking lot. Luckhurst has maintained he was merely cleaning up the parking lot; he says he picked up some feces and bread from the ground, placed it in a plastic “to go” container and set it down near a homeless man. Either way, the man didn’t eat it — after raising the sandwich to his mouth, he took a whiff and threw it down.
