Blagojevich’s lawyer, Leonard Goodman, tells WLS-AM that he’s taking the former Governor’s fight to get out of prison, to the U.S. Supreme Court which hasn’t taken up campaign fundraising since the 90’s.
“In a case called McCormick, they said we understand politicians have to ask people for money and those people expect something in return and they said very clearly ‘that’s not a crime’ and it’s even not a crime if you ask somebody for money after you’ve done something for somebody that’s benefiting them,” said Blagojevich attorney Leonard Goodman. “It becomes a crime and they set a very high bar – they said it becomes a crime only if there is an explicit promise to do one for the other. That was the law until U.S v. Blagojevich. They’ve now changed it, after the first trial, when they didn’t get a conviction they lowered the bar so low that really no politician could survive,” Goodman added.
Goodman says if the case is accepted, he’ll be the one standing before the justices.
”Rod Blagojevich is broke, he’s indigent. If he had a lot of money we could hire, you know, the fanciest Washington, D.C. law firms but he doesn’t have that money. So, he’s stuck with me.”
