(CHICAGO) Retailers have filed suit against the Cook County sweetened beverage tax about to go into effect.
Retailers argue that the tax is unconstitutional because it applies to different drinks differently.
Illinois Retailers Association leader Tanya Trische gives this example, “If I order a sweetened ice coffee in a bottle, that’s taxed. If I order a sweetened ice coffee that made by a barrista for me, that’s not taxed. They are not treating like things alike. That is a major concern for us and frankly is unlawful.”
Trische adds how retailers are supposed to charge the tax is too vague, but County Board President Toni Preckwinkle’s office says ” we will aggressively defend our position and the ordinance.”
